A request by the state of Ohio to transfer certain regulatory responsibilities regarding concentrated animal feeding operations (CAFOs) from the Ohio Environmental Protection Agency to the Ohio Department of Agriculture has been denied. The request was intended to streamline the permitting process and prevent duplication of efforts between the two agencies.

The Environmental Protection Agency (EPA) indicated that the request was incomplete under codified federal regulations and the state did not attempt to correct the deficiencies of the application when given the opportunity. The EPA did leave the door open to consider a revised request in the future if it incorporated statutory and regulatory changes that meet the Clean Water Act requirements.
